Welcome to 99active! These Terms of Service govern the use of our website and services. By using the website, you agree to these terms. If you do not agree with the Terms of Service or our Privacy Policy, we kindly ask you to refrain from using the website.


Definitions
acts
An act is an activity that you can offer or book on our platform. acts range from creative workshops to outdoor adventures. Providers can create acts in various categories, such as:
  • Food & Drink
  • Arts & Crafts
  • Nature & Outdoor
  • Health & Wellness
  • Music & Dance
  • Sports and much more.
Customers
Customers are users who book acts or purchase tickets on our marketplace.
Providers
Providers are users who offer acts and sell them through 99active.
Registration and User Accounts

Registration is required to offer acts or purchase tickets. Guests can buy tickets on our marketplace without registration, but they do not have the option to return tickets or use personalized features.


act Store

The act Store is the marketplace where acts are published by providers and can be discovered by customers. acts can be offered in various categories such as Food & Drink, Arts, Crafts, Sports, and many other areas. The act Store ensures that all listed acts are available for customers to book.


Rights and Obligations of Customers

Customers can purchase tickets for acts through the act Store. By purchasing a ticket, a binding agreement is formed between the customer and the provider of the act. Customers receive a confirmation and the ticket via email after purchase. Registered customers also have the option to manage their tickets in the “myacts” section.

Customers are obligated to adhere to the conditions of the booked act, including any return conditions set by the provider for each act.


Payment Terms
  • Payments for tickets are made via SEPA, PayPal, or credit cards.
  • The ticket service fee is included in the ticket price and is automatically accounted for with each purchase.
  • When returning a ticket, the ticket price is refunded minus the ticket service fees.

Subscriptions for Providers

We offer three flexible subscription plans for providers:

  1. Essential Plan: €0/month, 20% service fee.
  2. Growth Plan: €75/month or €750/year, 15% service fee and a dedicated page (URL) on 99active.
  3. Premium Plan: €100/month or €1,000/year, 10% service fee, access to the act handbook library, and advanced marketing services.

Booking Service

99active’s Booking Service handles the complete processing of ticket transactions. This includes:

  • Payment Processing: All ticket purchases are securely processed through our payment service providers.
  • Invoices and Tickets: After successful booking, the customer receives a confirmation, an invoice, and the ticket via email.
  • Ticket Management: Tickets are stored in the “myacts” section for registered users.
  • Participant List: The list of participants is updated in the provider workspace.
  • Sales Statistics: Sales are integrated into the provider’s daily sales statistics for the upcoming day.

Ticket Returns
  • Returns are only possible for registered users.
  • When returning a ticket, the ticket price is refunded minus the service fees.
  • Guest users do not have access to the ticket return function.

act Creation Tools
  • The act Creation Tool guides you step-by-step through creating professional act descriptions.
  • With the act Series Creation Tool, recurring acts (weekly or monthly) can be created and managed.

Participant Lists and act Payments

Providers receive a participant list via email one day before the act, which is always updated and viewable online in the provider workspace. Payment of act earnings is made 5-7 days after the act date to the provider’s specified bank account, provided there are no disputes. In case of disputes, the payment is delayed for the duration of resolving the disputes.


Provider Homepage (Growth Plan only)

With the Growth Plan, you get your own URL, e.g., https://99active.com/@[yourprovidername], to showcase and manage your acts. Here you can add contact information and centrally present all your offerings.


act Handbook Library (Premium Plan only)

The Premium Plan grants you access to the act Handbook Library, which contains detailed guides for various acts. These handbooks support providers in creating and conducting acts on 99active.


Business Consulting (Premium Plan only)

With the Premium Plan, you have the opportunity to book paid 1-on-1 business consulting sessions (60 € for 30 minutes). This consultation helps you with pricing strategy, market trends, and customer retention.


Tax Obligations

Providers are responsible for paying direct or indirect taxes, including business tax and value-added tax. The ticket price shown on the page includes all relevant taxes and fees.


Skills and Required Licenses

Providers must ensure they have the necessary skills and/or licenses to offer acts in their chosen category. This includes all professional qualifications, permits, or certifications required by local or national law to safely and legally offer a particular service. Providers are responsible for informing themselves about and complying with the applicable regulations in their field of activity.


Health and Safety

Providers are responsible for ensuring that their acts are conducted safely and in accordance with relevant health and safety regulations. This includes:

Ensuring that the venue is safe and participants are not exposed to unnecessary risks. Compliance with all local regulations regarding health and safety requirements. For outdoor or physical activities, special precautions should be taken to prevent accidents. Providers should inform themselves about the specific safety requirements for their act category and implement them conscientiously.


Youth Protection and Special Considerations for Children's acts

Providers offering acts for children are obligated to ensure youth protection. Sufficient accompanying persons must be available to ensure the safety of the children. This can be achieved by involving parents, grandparents, or other adults to ensure adequate supervision during the act.

Compliance with youth protection regulations and providing a safe environment are mandatory for providers.


Usage Rights and Intellectual Property

The content and layout of the website are the property of 99active and protected by copyright and trademark laws. 99active®, act®, and acts® are registered trademarks.


Security and Suspension

99active reserves the right to temporarily suspend provider accounts to prevent suspicious or fraudulent activities. Such suspensions may be triggered by security concerns or customer complaints.


Image License for acts

By uploading images to 99active, you grant us an unlimited license to use these images for the presentation and promotion of your acts. This also includes further processing as part of marketing materials.


Violations and Suspensions

99active manages reports of violations of the terms of use, including illegal activities, copyright infringements, and inappropriate content. Users can report violations to us, which will be reviewed by the Trust & Safety team.


User Generated Content (UGC)

All content uploaded by users (e.g., act descriptions, images, comments) is considered User Generated Content. 99active is not responsible for content created by users and reserves the right to remove this content if it violates the terms of use.


Privacy

The protection of your personal data is important to us. Our Privacy Policy explains how we collect, use, and protect your data. By using our website, you agree to the collection and use of your data in accordance with the Privacy Policy.
